License Agreement

Trial License

This license applies to the trial-licensed version of EASMTP Server (“EASMTP”). If you hold a Standard or Enterprise license for EASMTP, please refer to the corresponding section below.

NOTICE TO USER

You must read these terms and conditions carefully prior to installing this software. Your installation, distribution, or use of EASMTP constitutes your full acceptance of this License Agreement.

If you do not agree to any terms herein, you are prohibited from installing, distributing, or using EASMTP.

GRANT OF LICENSE

For each successful trial license registration, a non-exclusive license is granted to one single legal entity to use this software solely for testing, learning, or non-commercial project purposes, free of charge, for a period of thirty (30) days. If you continue using this software after the thirty (30)-day period, you must either extend your trial license or acquire a valid Standard or Enterprise license.

LIMITED WARRANTY

THIS SOFTWARE, AND ALL ACCOMPANYING FILES, DATA AND MATERIALS, ARE DISTRIBUTED "AS IS" AND WITH NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE SOFTWARE. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THE AGREEMENT.

ANY LIABILITY OF AIFEI & ADMINSYSTEM WILL BE LIMITED EXCLUSIVELY TO REFUND OF PURCHASE PRICE. IN ADDITION, IN NO EVENT SHALL AIFEI & ADMINSYSTEM, OR ITS PRINCIPALS, SHAREHOLDERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, SUBSIDIARIES, OR PARENT ORGANIZATIONS, BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER RELATING TO THE USE OF EASMTP, OR YOUR RELATIONSHIP WITH AIFEI & ADMINSYSTEM.

IN ADDITION, IN NO EVENT DOES AIFEI & ADMINSYSTEM AUTHORIZE YOU TO USE EASMTP IN APPLICATIONS OR SYSTEMS WHERE EASMTP'S FAILURE TO PERFORM CAN REASONABLY BE EXPECTED TO RESULT IN A SIGNIFICANT PHYSICAL INJURY, OR IN LOSS OF LIFE. ANY SUCH USE BY YOU IS ENTIRELY AT YOUR OWN RISK, AND YOU AGREE TO HOLD EASMTP HARMLESS FROM ANY CLAIMS OR LOSSES RELATING TO SUCH UNAUTHORIZED USE.

PROPRIETARY RIGHTS

This Agreement is the complete statement of the Agreement between the parties on the subject matter, and merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements. This Agreement shall be governed by the laws of Hong Kong. Exclusive jurisdiction and venue for all matters relating to this Agreement shall be in courts located in Hong Kong, and you consent to such jurisdiction and venue.

RESTRICTIONS

All rights of any kind in EASMTP which are not expressly granted in this license are entirely and exclusively reserved to and by AIFEI & Adminsystem. You may not rent, lease, modify, translate, reverse engineer, decompile and disassemble based on EASMTP. There are no third party beneficiaries of any promises, obligations or representations made by AIFEI & Adminsystem herein.

Standard License

This license applies to the standard-licensed version of EASMTP Server (“EASMTP”). If you hold an Trial or Enterprise license, please refer to the corresponding section.

NOTICE TO USER

You should read the following terms and conditions carefully before installing this software. Be aware that your use, distribution, or installation of this copy of EASMTP indicates your acceptance of this License.

If you do not agree to any of the terms of this License, then do not install, distribute or use this copy of EASMTP. If you paid AIFEI & Adminsystem Software Limited (AIFEI & Adminsystem) or an authorized AIFEI & Adminsystem distributor for this copy individually, you may return it unused, within thirty (30) days after purchase, for a full refund of your payment.

For each successful Standard License registration, a non-exclusive license is granted for a SINGLE legal entity to use EASMTP on ONE (1) server. This license is non-transferable; the registered license holder may not be modified, reassigned, or changed under any circumstances.

UPGRADE AND SUPPORT

Each Standard License includes twelve (12) months of complimentary technical support and software upgrades. Upon expiration of the free support and upgrade period, your licensed current version may be used perpetually; however, the license will not be valid for future new software versions. Optional annual support and upgrade maintenance may be purchased at a discounted rate.

LIMITED WARRANTY
